Privacy Policy

Article 1: Introduction

At REsimpli, LLC (“REsimpli,” “we,” “us,” “our”) we value your privacy and the importance of safeguarding your data. This Privacy Policy covers REsimpli, LLC’s policies on the collection, use, and disclosure of personally identifiable and other personal information (as defined by applicable law, including, but not limited to, the California Consumer Privacy Act of 2018, Civil Code sections 1798.100 et seq (“CCPA”)) (collectively referred to as “Personal Information”) when visitors and Subscribers (collectively “Users”) access www.REsimpli.com and/or the REsimpli mobile applications (collectively the “Platform”) and the software and services made available through the Platform (collectively the “Services”).

Please read the Privacy Policy carefully before using or accessing the Services. By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy.

Article 2: What Information Is Collected by REsimpli And How Is It Used?

2.1 What is Personal Data?

In this Policy, “Personal Data” refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or de-identified information that is maintained in a form that is not capable of being associated with or reasonably linked to an individual.

In addition to the data previously outlined in our policy, we may now collect the following personal information: First Name, Last Name, Email Address, Business Email, Company Domain, LinkedIn URL, City/State, and/or Phone Number. This data may be collected from various sources, including but not limited to direct user submissions, business interactions, and digital platforms.

Use of Collected Information: The collected information is used for business purposes, including improving our services, communication with clients, and marketing. With user consent, we may use the contact details provided to send promotional materials and updates about our services. Users have the option to opt-out of marketing communications at any time.

2.2 Categories of Personal Information

2.2.1 User Account: Upon account creation, Subscribers are required to furnish personal data, including, but not limited to, their legal first and last name, email address, time zone. This collection of personal identifiers is necessitated for the execution and management of the contractual relationship, facilitating the provision of our Services. Such information may be utilized for purposes including, but not limited to, (i) disseminating information pertinent to our Services; (ii) notifying changes to our Terms of Service and Privacy Policy; (iii) transmitting updates related to account management, customer support communications, marketing initiatives, and promotional content. Consent for such communication is deemed granted unless opted out by the Subscriber.

2.2.2 Email Addresses & Additional Contact Information: Users may voluntarily submit their email addresses and other contact details for purposes such as subscribing to our newsletters, engaging with customer support through our Platform, or for authentication processes like password resetting. Such users reserve the right to withdraw consent and unsubscribe from such communications through designated mechanisms within the communications received.

2.2.3 Subscriber Mailing Address: Subscribers opting for direct mail campaign services via the Platform are obliged to provide their full name and a valid return mailing address for the purpose of campaign identification and regulatory compliance.

2.3 Non-Personal Data

Definition and Scope

For the purposes of this Privacy Policy, “Non-Personal Data” shall refer to data that, by itself, does not permit direct association with any specific individual. We may collect Non-Personal Data, including but not limited to Usage Data, during your interaction with the Platform.

Types of Non-Personal Data and Methods of Collection

  1. Usage Data: Automatically generated information, which may be collected passively through various technologies such as cookies, log files, and similar data-gathering mechanisms, may include but is not limited to:
  • Internet Protocol Address (IP Address): A numerical label assigned to your device participating in a computer network that uses the Internet Protocol for communication.
  • Browser Type: Information about the web browser software you are using to interact with the Platform, including version and language settings.
  • Diagnostic Data: This could encompass data necessary for the diagnosis of operational problems, the optimization of operational functionalities, and the conduct of performance analytics to improve the Platform’s overall efficacy.
  1. b) Aggregated Data: We may also gather aggregated data, which is statistical information that is not associated with any single user account and is used for analytical purposes.

Purpose of Collection

Non-Personal Data is utilized for various purposes, including but not limited to:

  • Enhancing your user experience by optimizing our Platform functionalities.
  • Conducting internal operations such as debugging, data analysis, and research to improve the Platform’s performance.
  • Generating analytical insights to assist in marketing strategies.
  • Ensuring the security and integrity of the Platform and its data.

Article 3: Cookies Policy and Tracking Mechanisms

REsimpli utilizes cookie technology to gather information on Internet use in order to serve its Users more effectively. As described in Section 2, REsimpli also utilizes third party analytics services which may also use tracking cookies to provide information about the use of our Platform. Users can set your browser to remove or reject cookies and/or accept or refuse cookies on the cookie consent banner on the site itself; however, some Platform features or Services may not work properly without cookies.

Article 4: Is Information Collected By Or Disclosed To Third Parties?

4.1 RESIMPLI DOES NOT AND WILL NOT SELL, RENT, OR LEASE PERSONAL INFORMATION. HOWEVER, PERSONAL INFORMATION IS PROCESSED BY SERVICE PROVIDERS WHO HAVE CONTRACTED WITH RESIMPLI TO FACILITATE THE PROVISION OF SERVICES THROUGH THE PLATFORM AS FOLLOWS

4.2 Integrated API’s:REsimpli has integrated the following API’s:

  • Geolocation Integration: REsimpli has integrated the Google API to incorporate Google Maps and to utilize geolocation in connection with the Services. For more information on the privacy policy of this service, please see: Google’s Privacy Policy. Subscribers can review and manage their key privacy settings using Google’s Privacy Checkup
  • Calendar Integration: Notwithstanding anything else in this Privacy Policy, if you provide the App access to your Google data, the App’s use of that data will be subject to these additional restrictions:
    • REsimpli will use https://www.googleapis.com/auth/calendar.events to allow our users to view, create, edit or delete any events in REsimpli and sync those events with our users’ Google Calendar. REsimpli will also use this to allow our users to edit or delete events from their Google Calendar that are synced with REsimpli. Once a Google Calendar event that is synced with REsimpli is edited or deleted in Google Calendar, that event will also get edited or deleted in REsimpli.
  • Google Gmail API Disclosure: Subscribers can opt to integrate the Google Gmail API to Allow users to read, write, modify or control Gmail message. Integration will also enable Subscriber’s google gmail  to read, write, modify or control Gmail message. Prior to integration opt-in, Google will display a consent screen asking to authorize to data for purposes of integrating with Platform services. Please review the Google privacy policy for more information relating to Google’s privacy practices.
    • We leverage Google APIs to pull in email, contacts and calendar data of our users in order to:
      • Allow users to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read and process emails.
      • Scan their emails for messages related to sales activities + display them within our application with some action items.
    • The App will not use Google data for serving advertisements
    • The App will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the App’s internal operations and even then only when the data have been aggregated and anonymized.
    • The Resimpli’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
  • Subscribers can opt to integrate Zillow to retrieve and display dynamic content from Zillow within the Platform through the Zapier API. Personal Information is processed pursuant to a Data Processing Addendum with Zapier; please see the Zapier Privacy Policy; and Zillow Privacy Notice for more information on their respective privacy practices.
  • Banking Information: Subscribers can opt to integrate the Finicity API to link their bank accounts to facilitate use of certain Platform services. Please see the Finicity Privacy Policy for additional information.
  • Direct Mail Postcards. The Platform utilizes the Lob Direct Mail Postcards API to automate direct mail campaigns organized and managed by its subscribers. Subscribers will share name, address, phones and email to facilitate direct mail campaigns. Please see Lob Direct Mail Platform for additional information.

4.3 Customer Services Support: REsimpli utilizes MailChimp to communicate with you by exchanging service-related notifications. Please see the MailChimp hyperlink for more information on their data collection and use practices.

4.4 Social Plug-Ins: Users may follow REsimpli and/or share information on Facebook, Instagram and YouTube. Users should click on the hyperlinks for each site to review the applicable privacy policies for more detail about information collected by these sites.

4.5 Google Analytics: REsimpli utilizes Google Analytics to access anonymized data to help us understand how our Services are used. Google Analytics is a web analytics tool that helps REsimpli understand how users engage with the Platform, so that we can review and improve our Services. Google Analytics collects information anonymously. It provides a report to REsimpli with website trends without identifying individual visitors. Please see the Google Privacy Policy for more information on their privacy disclosures. If you do not want your data to be used by Google Analytics, you may opt-out by installing Google Analytics Opt-out Browser Add-on.

4.6 Credit/Debit Card Information: REsimpli does not itself store debit or credit card information on its servers. REsimpli utilizes Stripe to process payments on the Platform. Please see Stripe’s Privacy Policy for more information on their privacy disclosures.

4.7 Customer Support: REsimpli utilizes Zendesk for in-Platform customer support services. Please refer to the Zendesk Privacy Policy for additional information on privacy practices.

4.8 Data Enrichment: REsimpli obtains real estate data from a third party service provider, Melissa, Inc. to facilitate a Subscriber’s project analysis and marketing communications relating to various real properties identified as properties of interest to a Subscriber. Please see Melissa Privacy Policy for additional information.

4.9 CRM Data input by Subscribers: The Platform enables Subscribers to input lead generation content for marketing and communication purposes. Such information is collected directly by Subscribers and input into the Platform at Subscriber’s discretion, including a lead’s name, phone, email, url, real property address, mortgage, valuation and related financial information relating to certain real property.

4.10 Subcontractor Data input by Subscribers: The Platform enables Subscribers to create a subcontractor database to assist with real estate projects managed through the Platform. Subscribers may optionally enter Personal Information and business data for purposes of engagement and payment of subcontractors, including name, phone, address, EIN/SS numbers, insurance, business license and bond information obtained from the subcontractor by Subscriber or through publicly available sources.

4.11 Web Hosting Services: The Platform and Personal Information collected is encrypted in transit and in storage on cloud servers maintained by AWS. Please see the AWS Data Privacy Compliance Statement for more information on their privacy and security practices.

4.12 Other Potential Third Party Disclosures: Personal Information may be disclosed to third parties to serve our legitimate business interests as follows: (1) as required by law, such as to comply with a subpoena, or similar legal process, (2) if REsimpli is involved in a merger, acquisition, or sale of all or a portion of its assets, (3) to investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (4) enforce our agreements with you, and/or (5) investigate and defend ourselves against any third-party claims or allegations. We will use commercially reasonable efforts to notify you about law enforcement or court ordered requests for data unless otherwise prohibited by law.

Article 5: How Does REsimpli Comply With The Children’s Online Privacy Protection Act and Other Privacy Regulations Relating to Children?

We take the privacy of children very seriously. As a general rule, REsimpli does not knowingly collect Personal Information from anyone under the age of 18. If a parent or guardian becomes aware that his or her minor child as defined by applicable privacy laws has provided Personal Information without their consent, he or she should contact REsimpli at the contact us details provided at the bottom of this Privacy Policy.

REsimpli will delete such Personal Information from our files within a commercially reasonable time, but no later than required under applicable law.

Article 6: How Long Does REsimpli Retain Personal Information Collected?

Unless erasure is otherwise requested by a Subscriber, REsimpli will retain account and purchase data as long as it is necessary to provide services our Subscribers. When a Subscriber’s account is terminated or closed upon request, Personal Data collected through the Platform will be deleted in accordance with applicable law. Personal Information obtained from Platform visitors will be maintained as long as it is necessary to provide requested communications and information-based services or until a visitor exercises the right to opt-out of requested communications or information-based services. Anonymized and pseudo-anonymized data will be retained as long as REsimpli determines such data is commercially necessary for it legitimate business interests.

Article 7: Your Rights to Your Personal Data

7.1 Depending on your geographical location and citizenship, your rights are subject to local data privacy regulations.

These rights may include :

  • Right to Access. You have the right to request a copy of the personal data we are processing about you.
  • Right to Rectification. You have the right to have incomplete or inaccurate personal data that we process about you rectified.
  • Right to be Forgotten (right to erasure). You have the right to request that we delete personal data that we process about you, except we are not obliged to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.
  • Right to Restriction of Processing. You have the right to restrict our processing of your personal data where you believe such data to be inaccurate; our processing is unlawful; or if we no longer need to process such data for a particular purpose unless we are not able to delete the data due to a legal or other obligation or because you do not wish us to delete it.
  • Right to Portability. You have the right to obtain personal data we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal data which you have provided to us, and (b) if we are processing that data on the basis of your consent or to perform a contract with you or the third party that subscribes to our services.
  • Right to Objection. Where the legal justification for our processing of your personal data is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise or defense of a legal claim.
  • Right Not to Be Discriminated. You have the right not to be denied service or have an altered experience based on having executed any of your rights.

7.2 Withdrawing Consent

If you have consented to our processing of your personal data, you have the right to withdraw your consent at any time, free of charge, such as where you wish to unsubscribe from marketing messages that you receive from us. If you wish to withdraw your consent, please contact us using the information found at the bottom of this page.

7.3 How to Exercise Your Rights

You can make a request to exercise any of these rights in relation to your personal data by sending the request to our privacy team by using the contact details below. For your own privacy and security, at our discretion, we may require you to prove your identity before providing the requested information.

Article 8: YOUR CALIFORNIA PRIVACY RIGHTS

California Consumer’s Request to Know, Right to Delete, Right to Opt-Out of Sale Notices. For Information on your California Consumer Rights, please see: California Consumer Privacy Rights Notice (“Notice”). A Verifiable Consumer Request under this Section may be submitted to REsimpli by emailing REsimpli at info@REsimpli.com or through the account or as otherwise designated in the Notice.

For each request, REsimpli will initially verify the email address on file with the email address submitted in the applicable request. Further verification will be based upon confirmation of data correlating to information maintained by REsimpli, as applicable. Consumers may designate an authorized agent to make a request on the Consumer’s behalf a info@REsimpli.com Requests by authorized agents are subject to additional verification requirements pursuant to the rules and regulations set forth in the CCPA.

Article 9: What Is the REsimpli Security Policy?

The security of your data is important to us. We have implemented reasonable administrative, technical and physical security measures to protect Personal Information against unauthorized access, destruction or alteration.

REsimpli utilizes only PCI-DSS compliant third party payment processors to ensure the security of your personal information. Credit/debit card information provided is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. However, security risk is inherent in all internet and no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee its security.

Article 10: How Does The Platform Respond To “Do Not Track” Signals?

“Do Not Track” is a feature enabled on some browsers that sends a signal to request that a website disable its tracking or cross-site user tracking. At present, the Platform does not respond to or alter its practices when a Do Not Track signal is received.

Article 11: How Will I Be Notified Of Changes To Your Privacy Policy?

If we make material changes to our Privacy Policy, we will notify you by (1) changing the Effective Date at the top of the Privacy Policy, or (ii) sending an electronic notification to all active account holders, or (iii) adding a banner/notification to the Platform itself.
